Article 1 - Identity

Article 2 - Definitions

In these general terms and conditions, the following terms shall have the following meanings:

  1. Grace period: The period within which a consumer can make use of his right of withdrawal;
  2. Consumer: the natural person who is not acting for purposes relating to his trade, business, craft, or profession;
  3. Day: calendar day;
  4. Durable medium: every tool - including e-mail - which enables a consumer or Leyen to store information that is addressed to him personally, in a way that allows future consultation or use during a period that is tailored to the purpose for which the information is intended, and which enables the unaltered reproduction of the stored information;
  5. Right of withdrawal: the possibility for a consumer to waive the distance contract within the cooling-off period;
  6. Distance contract: an agreement between Leyen and a consumer is closed in the context of an organized system for distance selling of products, whereby to the conclusion of the agreement exclusive or partial use is made of one or more means of distance communication;
  7. Technique for distance communication: this means that can be used for concluding an agreement, without the consumer and Leyen having to be in the same room at the same time.

 

Article 3 - Applicability

  1. These general terms and conditions apply to every offer made by Leyen and to every distance contract which has been concluded between Leyen and a consumer.
  2. Before the remote agreement is closed, the text of these general conditions will be made available to the consumer electronically in such a way that the consumer can easily store them on a durable data carrier. If this is not reasonably possible, Leyen will, before the agreement at a distance is closed, indicate in which way the general conditions can be consulted electronically and that they, at the request of the consumer, will be sent electronically or otherwise, free of charge.

 

Article 4 - The offer

  1. If an offer has a limited period of validity or is made subject to conditions, this will be explicitly stated in the offer.
  2. Obvious mistakes or obvious errors in the offer of products do not bind Leyen.
  3. Each offer contains such information that it is clear to the consumer what rights and obligations are attached to accepting the offer.

 

Article 5 - The agreement

  1. The contract is concluded at the moment the consumer accepts the offer and fulfills the conditions set out therein.
  2. If the consumer has accepted the offer electronically, Leyen will immediately confirm the receipt of the acceptance of the offer electronically.
  3. Leyen will provide the consumer with the following information, at the latest upon delivery of the product:
  4. The email address of Leyen where the consumer can go for example with complaints;
  5. The conditions on which and the way in which the consumer may exercise the right of withdrawal or a clear statement concerning the exclusion of the right of withdrawal;
  6. The price including all taxes of the product, where applicable the costs of delivery and the method of payment, delivery or implementation of the distance contract;

 

Article 6 - Right of withdrawal

  1. The consumer can dissolve an agreement concerning the purchase of a product during a reflection period of 14 days without giving any reason. Leyen is allowed to ask the consumer for the reason for withdrawal, but the consumer is not obliged to give his/her reason(s).
  2. The cooling off period mentioned in paragraph 1 starts on the day after the consumer, or a third party designated by the consumer in advance, and who is not the carrier, has received the product, or:

 

Article 7 - Obligations of the consumer during the reflection period

  1. During the cooling-off period the consumer will handle the product and the packaging with care. He will only unpack the product; the starting point here is that the consumer may only handle and inspect the product as he would in a shop.
  2. The consumer is liable for any reduction in the value of the product resulting from a manner of handling the product that goes beyond that permitted in paragraph 1.

 

Article 8 - Exercise of the right of withdrawal by the consumer and costs thereof

  1. If the consumer uses his right of withdrawal, he will report this within the cooling-off period unambiguous to Leyen.
  2. As soon as possible, but within 14 days from the day following the notification referred to in paragraph 1, the consumer will return the product, or hand it over to (an authorized representative of) Leyen. This is not necessary if Leyen has offered to pick up the product themselves. The consumer has in any case complied with the return period if he or she returns the product before the cooling-off period has expired.
  3. The consumer will return the product with all delivered accessories, in original condition and packaging, and according to the instructions provided by Leyen. 
  4. The risk and burden of proof of the correct and timely exercise of the right of withdrawal shall lie with the consumer.
  5. The consumer bears the direct costs of returning the product.
  6. Further necessary information about returning a product is mentioned on the website under the "shipping and returns" page.
  7. If the consumer makes use of his right of withdrawal, all additional agreements will be dissolved by the operation of law.
  8. If the consumer only returns a part of the order, then the possible delivery costs do not have to be paid back by Leyen.

 

Article 9 - Obligations of Leyen in case of revocation

  1. Leyen will refund all payments made by the consumer, without delay but within 14 days following the day on which Leyen received the return package.
  2. Leyen uses for reimbursement the same means of payment the consumer used unless the consumer agrees to a different method. The refund payment will be free of charge for the consumer.

 

Article 10 - The price

  1. During the validity period mentioned in the offer, the prices of the products offered will not be increased, except for price changes due to changes in VAT rates.
  2. The prices mentioned in the offer of products include VAT.

 

Article 11 - Fulfillment of agreement and additional guarantee

  1. Leyen guarantees that the products meet the agreement, the specifications listed in the offer, the reasonable requirements of reliability and/or usability, and on the date of the conclusion of the agreement existing legal provisions and/or government regulations.
  2. In any case, no claim can be made under paragraph 1 of this article (i) in the case of damage caused intentionally or through negligence, (ii) in the case of normal wear and tear, and/or (iii) in the case of damage caused by failure to comply or to comply properly with the instructions for use.
  3. An extra guarantee given by Leyen, its supplier, manufacturer, or importer will never limit the legal rights and claims that the consumer can exercise against Leyen on the basis of the agreement if Leyen has failed to fulfill its part of the agreement.
  4. By extra guarantee is meant for every commitment of Leyen, its supplier, importer, or producer in which they grant certain rights or claims to the consumer that goes beyond what the consumer is legally obligated to do in case he or she has failed to fulfill his or her part of the agreement.

 

Article 12 - Delivery and execution

  1. Leyen will take the greatest possible care when receiving and executing product orders.
  2. Delivery takes place as long as stocks last.
  3. The ownership of delivered products is transferred to the consumer after payment of the amount due. The risk of the products is transferred at the time of delivery to the consumer.
  4. The place of delivery is the address that the consumer has made known to Leyen.
  5. The consumer must give the correct address and email address to Leyen. Also, any changes of this address need to be passed on to Leyen. If the consumer has given the wrong address for the delivery, this is the risk of the consumer.
  6. Leyen will execute accepted orders with speed but at the latest within 2-6 working days, but we aim at 1-3 business days.
  7. After dissolution in accordance with the previous paragraph, Leyen will refund the amount paid by the consumer without delay.
  8. The risk of damage and/or loss of products rests with Leyen until the time of delivery to the consumer or a previously designated and made to Leyen representative, unless otherwise expressly agreed.

 

 

Article 13 - Payment

  1. Leyen offers the following safe payment methods:

 - iDEAL: buyers with a Dutch bank account can use iDeal. This payment method was created with the cooperation of the Dutch banks. The iDeal payment system connects the most common online banking systems and is a reliable payment system.

- PayPal: using PayPal, the buyer can transfer money from their bank account, credit card account, or PayPal account. (Note: this method is currently not working)

-Credit card: during the ordering process, the buyer can enter his credit card number and the expiration date of his credit card. The buyer must make sure that exactly the same name is entered as on the credit card. This is followed by the authorization process for the payment. The buyer will hear whether or not the payment has been approved.

  1. The buyer is bound by the conditions of the payment platform chosen by him/her for the payment. Leyen has no power over these conditions and cannot be held responsible for their content.

 

Article 14 - Force majeure

Leyen and the consumer are not obliged to fulfill any obligations if they are hindered due to a circumstance that is not due to her fault, and under the law, a legal act or generally accepted practice.

 

Article 15 - Complaints procedure

Complaints submitted to Leyen will be answered within a period of 14 days, counting from the date of receipt. Suppose a complaint requires a foreseeable longer time to process. In that case, Leyen will answer within 14 days with a notice of receipt and indicate when the consumer can expect a more detailed answer.

 

Article 16 - Other

  1. Any deviations from these general terms and conditions can only be agreed in writing. No rights can be derived from such deviations with regard to legal relationships entered into later.
  2. The administration of Leyen counts, subject to proof, as evidence of the applications and/or orders made by the consumer. The consumer acknowledges that electronic communication may serve as proof.
  3. Leyen is entitled to transfer the rights and obligations from the agreement with you to a third party by a single notification to you.
  4. If and as far as any stipulation of the general terms and conditions is declared void or annulled, the other stipulations of these general terms and conditions will remain in full force. Leyen will draw up a new provision to replace the void/canceled provision, which will take the intention of the void/canceled provision into account as much as possible.

 

Article 17 - Applicable law and jurisdiction

  1. On agreements, and all resulting non-contractual obligations, between Leyen and the consumer to which these general conditions relate, only Dutch law applies.

Article 18 - Copyright

It is forbidden to copy, publish, reproduce or otherwise use text and/or visual material and/or designs from Leyen without permission.

Article 19 - Cookies

Cookies are used on the website to improve your browsing experience. In addition, to use for statistical purposes, cookies identify your computer and allow the website to recall your personal settings. Your browser can be set to send a notification when a cookie is activated. This allows you to deny the use of this cookie or to delete the cookie at the end of your visit. The webshop cannot be accessed if cookies are disabled.
